Australia faces drone war crime charges: Pakistan

Australia will have to end its complicity in US drone attacks on civilians in Pakistan or face war crime accusations at the International Criminal Court, according to a Pakistan lawyer and rights campaigner.
Shahzad Akbar said Australia would face immediate scrutiny of its involvement in the ''targeted killings'' by drone missiles via the Pine Gap spy base in central Australia, revealed by Fairfax on Sunday.
Speaking at a Monash University human rights conference in Melbourne on Friday, Mr Akbar said the Pakistan government would have no option but to pursue Australia at the international court and the UN Security Council because it had been explicitly instructed to do so by a Pakistan High Court.
''Making this happen is my day and night work now,'' said Mr Akbar, director of the Foundation for Fundamental Rights, who represents more than 150 civilian victims of drone attacks.
Mr Akbar said the attacks were categorically illegal under international law because they took place without approval by Pakistan or the United Nations.
The US was not a signatory to the court, but Australia, the UK and Germany could face accusations.
Pine Gap is used to track al-Qaeda and Taliban militants' communications and feed their positions to the controversial drone strike program and other military operations.
The drone strikes are claimed to have killed more than 2500 militants, but also 1400 civilians, according to Mr Akbar.
An Australian is deputy chief of Pine Gap and Australians are said to have helped target drone strikes.
''We have to see what comes out, but if Australian personnel are actively participating in strikes that have killed women, children and rescue workers, these have been categorised as war crimes under international law,'' Mr Akbar said.
Mr Akbar and his supporters will pursue answers in Britain and Australia by means including freedom-of-information requests, questions in Parliament, judicial reviews and court cases seeking compensation for victims.
''Within three to six months we will file to find out more about Pine Gap,'' he said.
Supporters were also examining legal options for enforcing Pakistan court orders in Australia.
A war crimes case could only be brought by the Pakistan government.
Mr Akbar agreed it would probably be reluctant but said it would have no choice because of the orders made in May by the Peshawar High Court.
''We have an independent judiciary that is very critical of the executive,'' he said.
Then-prime minister Yousuf Raza Gillani defied a court, was convicted of contempt in 2012 and lost his career.
Should the current government fail to act, Mr Akbar said he would launch new contempt proceedings.
''So it will have no option.   And once it does, the Australian government has to appear to do the right thing, it can't appear to just brush it aside.''
Pakistan also has been ordered to complain to the UN Security Council.

The Medicines Healthcare Products Regulatory Agency — MHRA — first interference was to encourage health professional not to report adverse reactions.
This was done in formal advice issued in the name of Chief Executive Professor Sir Kent Woods telling health professionals that reactions can be “psychogenic” — or in simpler terms a figment of 12 year old schoolgirls’ imaginations and nothing to do with the vaccines.
Next the data from over 6000 reports of suspected adverse reactions was systematically altered resulting in the MHRA declaring the vaccine safe when it was not.
The third thing the MHRA staff did was to fix the final figures to make the rate of adverse reactions appear lower by substituting the number of doses given for the number of children receiving the vaccine.
The crucial figure was not the number of doses but the number of children who suffered reactions compared to the total number of children.
The MHRA was headed at the time by Chairman Professor Alasdair Breckenridge — retired December 2012 — and Professor Sir Kent Woods — MHRA Chief Executive but shortly expected to retire after 10 years service.
Who instructed staff of the UK’s Medicines Healthcare Products Regulatory Agency [MHRA] systematically to tamper with the reporting systems and with data in reports of adverse reactions by medical professionals to Cervarix HPV vaccines given to millions British Schoolgirls from December 2008 to July 2012?
Who instructed that none of the adverse reaction reports should be followed-up and conditions of the children investigated?
In 2012 GSK’s Cervarix HPV vaccine was replaced by Merck’s Gardasil HPV vaccine.
At the time this was claimed to be a result of competitive tendering.
However it is a requirement that the Department of Health is required to ensure vaccine supply is not from a sole source.
This requirement was made following criticism in the English Parliament and by the UK National Audit Office over problems caused previously by the failure of a sole source of supply of a different vaccine.
The male dominated MHRA was telling medical professionals to dismiss adverse reactions in schoolgirls because women are prone to that sort of thing — you know — women are silly, emotional and prone to hysteria and mass hysteria.

BT accused of aiding US lethal drone attacks

The UK communications giant, BT, is facing a government investigation for allegedly aiding lethal and illegal US drone strikes in Yemen and Somalia.
The human rights group, Reprieve, has lodged a formal complaint with the UK Government against the company, arguing that it has breached guidelines on responsible business behaviour drawn up by the 34-country Organisation for Economic Co-operation and Development (OECD).
Reprieve has obtained details of a $23 million deal agreed last September between BT and the US government's Defense Information Systems Agency to connect the US drone base at Camp Lemonnier in African republic Djibouti by fibre-optic cable to RAF Croughton in Northamptonshire, which serves as a major US communications base.
Lemonnier is the main centre for US drone operations outside Afghanistan. It sends Predator and Reaper unmanned aerial vehicles armed with Hellfire missiles on "targeted killing" missions against suspected terrorist cells in Yemen and Somalia.

No war has been declared
But Reprieve says the attacks violate international law because they are carried out in areas where no war has been declared.
In January, the United Nations launched an investigation into the legality and casualties of the strikes, headed by the special rapporteur on human rights and counter-terrorism, British barrister Ben Emmerson QC.
According to the Bureau of Investigative Journalism at City University in London, confirmed drone strikes in Yemen have killed between 240 and 349 people since 2002, with a further 283-456 left dead by 'possible' strikes.
Between 37 and 97 of those killed were said to be civilians, up to 11 of them children.
There is less information available for Somalia where, since 2007, up to 27 people have been reported killed by drones, maybe 15 of them civilians.
Because the operations are shrouded in secrecy, it is difficult to be certain of the exact death toll.

AMY GOODMAN:  Our guests today Dr. Cornel West, professor at Union Theological Seminary, author of numerous books, co-host of the radio show Smiley & West with Tavis Smiley.
Together, they wrote the book The Rich and the Rest of Us: A Poverty Manifesto.  Professor Cornel West:
CORNEL WEST:    Well, the first thing, I think we have to acknowledge that President Obama has very little moral authority at this point... because he tries to rationalize the killing of innocent children, 221 so far, in the name of self-defense... in Pakistan, Somalia, Yemen.
So when he comes to talk about the killing of an innocent person, you say, "Well, wait a minute.   What kind of moral authority are you bringing?
You’ve got $2 million bounty on Sister Assata Shakur.   She’s innocent, but you are pressing that intentionally.
Will you press for the justice of Trayvon Martin in the same way you press for the prosecution of Brother Bradley Manning and Brother Edward Snowden?
So you begin to see the hypocrisy.
Then he tells stories about racial profiling.
They’re moving, sentimental stories, what Brother Kendall Thomas called racial moralism, very sentimental.
But then, Ray Kelly, major candidate for Department of Homeland Security, he’s the poster child of racial profiling.
You know, Brother Carl Dix and many of us went to jail under Ray Kelly.
Why?
Because he racially profiled millions of young black and brown brothers.
AMY GOODMAN:    Ray Kelly... police chief of New York City.
CORNEL WEST:    He even says Ray Kelly expresses his values.
Ray Kelly is a magnificent police commissioner.
How are you going to say that when the brother is reinforcing stop and frisk?
So the contradictions become so overwhelming here.
AMY GOODMAN:    But President Obama, speaking about his own life experience, going from saying, "Trayvon Martin could have been my child," to "Trayvon Martin could have been me"?
CORNEL WEST:    That’s beautiful.
That’s an identification.
The question is: Will that identification hide and conceal the fact there’s a criminal justice system in place that has nearly destroyed two generations of very precious, poor black and brown brothers?
He hasn’t said a mumbling word until now.
Five years in office and can’t say a word about the new Jim Crow.
And at the same time, I think we have to recognize that he has been able to hide and conceal that criminalizing of the black poor as what I call the re-niggerizing of the black professional class.
You’ve got these black leaders on the Obama plantation, won’t say a criminal word about the master in the big house, will only try to tame the field folk so that they’re not critical of the master in the big house.
... Obama and Holder, will they come through at the federal level for Trayvon Martin?
We hope so.
Don’t hold your breath.
And when they don’t, they’re going to have to somehow contain that rage.
And in containing that rage, there’s going to be many people who say, "No, we see, this president is not serious about the criminalizing of poor people."
We’ve got a black leadership that is deferential to Obama, that is subservient to Obama, and that’s what niggerizing is.
You keep folks so scared.
You keep folks so intimidated.
You can give them money, access, but they’re still scared.
And as long as you’re scared, you’re on the plantation.
