Justice Department Examines Videos Prison Officials Said Were Destroyed

Hundreds of videotapes that federal prison officials had claimed were destroyed show that foreign nationals held at a New York detention facility after the Sept. 11, 2001, attacks were victims of physical and verbal abuse by guards, the Justice Department's inspector general said yesterday.
An investigation by Inspector General Glenn A. Fine also found that officials at the Metropolitan Detention Center (MDC) in Brooklyn, N.Y., which is run by the U.S. Bureau of Prisons, improperly taped meetings between detainees and their lawyers, and used excessive strip searches and restraints to punish those in confinement.
The report concluded that as many as 20 guards were involved in the abuse, which included slamming prisoners against walls and painfully twisting their arms and hands. Fine recommended discipline for 10 employees and counseling for two others who remain employed by the federal prison system. He also said the government should notify the employers of four former guards about their conduct.
"Some officers slammed and bounced detainees against the wall, twisted their arms and hands in painful ways, stepped on their leg restraint chains and punished them by keeping them restrained for long periods of time," the report said. "We determined that the way these MDC staff members handled some detainees was, in many respects, unprofessional, inappropriate and in violation of BOP policy."
One focus of the report was an American flag T-shirt that hung from a wall at the MDC with the slogan, "These colors don't run." Four corrections employees told investigators that the shirt, which hung in a prisoner receiving area for months, was covered with bloodstains, including some that appeared to have come from detainees being slammed into the wall.
A report issued by Fine in June found "a pattern of physical and verbal abuse" at the Brooklyn detention facility's Special Housing Unit, where 84 of the men picked up after the Sept. 11 attacks were held. But investigators said then that firm conclusions on abuse were impossible in many cases because of the lack of videotapes, which prison administrators said at the time had been destroyed.
Justice Department spokesman Mark Corallo said yesterday that federal prosecutors in Brooklyn and in the department's Civil Rights Division were reviewing the report to determine whether criminal charges were warranted. The Justice Department had previously declined to pursue any prosecutions in the cases.
"We agree with the inspector general that even the intense emotional atmosphere surrounding the attacks, particularly in New York City, where smoke was still rising from the rubble of Ground Zero, is no excuse for abhorrent behavior by Bureau of Prisons personnel," Corallo said in a statement. "It is unfortunate that the alleged misconduct of a few employees detracts from the fine work done by the correctional personnel at MDC and around the nation, who conducted themselves professionally and appropriately."
Bureau of Prisons officials declined to comment, referring all questions to the Justice Department.
Barbara J. Olshansky, deputy legal director at the Center for Constitutional Rights, a New York-based civil liberties group that is suing the federal government on behalf of detainees, said the report "is astounding confirmation of what we've alleged all along. This goes into exactly what kind of physical and verbal abuse there was and what the contradictions of the government's position has been. . . . It's clear that there was no provocation at any point, and clear that there was no justification for excessive force at any point."
A federal dragnet after the Sept. 11 attacks resulted in the detention of more than 1,200 foreign nationals, including 762 people who were the focus of Fine's original probe. Most were of Arab or South Asian descent and were held on immigration violations under a directive from Attorney General John D. Ashcroft while authorities attempted to determine whether they were connected to the attack or to terrorist groups. None was ever charged with terrorism-related crimes, however.
Many of the incidents of abuse were confirmed when investigators viewed more than 300 videotapes recorded from October to November 2001 that showed detainees being moved around the facility and within their cells, investigators said. Corrections officers who had been interviewed earlier had denied that many of the incidents occurred. MDC Warden Michael Zenk and other officials repeatedly told Fine's investigators that the videotapes had been destroyed as part of a recycling policy, the report said.
The tapes eventually located in August had not been included on inventory sheets provided by the prison and were held in a storage room that also had not been disclosed to investigators, the report said. Many tapes from the period are still missing, and there are unexplained gaps the ones that were found, the report shows.
Many detainees also told investigators that, in the month before the installation of the camera system in October 2001, jail conditions and abuse had been much worse, the report noted. The cameras were installed in part to protect jail officers from unwarranted allegations, Fine said.
Fine said in an interview that the prison system's failure to turn over all the videotapes "significantly delayed and hindered our investigation," but "we did not find sufficient evidence to prove it was an effort to cover anything up."
He said he remained concerned about allegations of abuse in the weeks before the installation of a video system. "If these incidents are an indication of what was done in front of the camera, what may have occurred without them?" Fine asked. "It's cause for significant concern."
The public version of the report released yesterday does not name individual corrections officers or detainees, but it does describe in detail an unspecified number of violent incidents captured on film or witnessed by guards and law enforcement officials. Several lieutenants and officers interviewed by investigators indicated that they had seen incidents of abuse. One lieutenant told another that "slamming detainees against the wall was all part of being in jail and not to worry about it," the report said.
Another MDC officer said in an affidavit that "there were some lieutenants . . . who would [rein] in an officer for bouncing a detainee against the wall, but there were probably other lieutenants who would let it slide."
During two incidents captured on videotape, the report said, "we observed officers escort detainees down a hall at a brisk pace and ram them into a wall without slowing down before impact." In the numerous "slamming" incidents recorded on tape, the report said, there was no evidence that the detainees had provoked or attacked the guards.
On more than 40 occasions, the report found, MDC staff members recorded detainees' visits with their attorneys using video cameras set up on tripods outside visiting rooms. The tapes routinely captured "significant portions" of conversations between the detainees and legal counsel. In some cases, detainees were instructed not to speak in Arabic or to speak in English because they were being taped.
Such taping is a violation of federal regulations, Fine's investigation found. Prisons rules permit videotaping, but not audiotaping, of attorney visits.
Zenk, the prison warden, told investigators that the cameras were moved farther from the visiting room after an attorney complained in November 2001. But the report says that "as late as February 2002, conversations between detainees and their attorneys are still audible on many of the tapes."
Although the taping "potentially stifled detainees' open and free communications with legal counsel," the report noted that some of the recordings include allegations of physical and verbal abuse that were consistent with the allegations being probed.
The report found two incidents in which inmates were locked in restraints for more than seven hours despite no signs of resistance.

Thousands of Palestinians say they were tortured by Israel
Israeli lessons for the US in Iraq

The torturing of Iraqi prisoners at the Abu Ghuraib prison by US occupying forces has shocked the world — but for most Palestinians they come as no surprise.
In fact, tens of thousands of Palestinians who have served time in Israeli prisons and detention centres see striking similarities between Israeli treatment of Palestinian prisoners and American treatment of Iraqi detainees.
In some cases, the torture technique or form of mistreatment is almost identical, some former Palestinian prisoners told Aljazeera.net.
Hisham Abd al-Razzaq is a Palestinian Authority minister in charge of overseeing and catering for more than 7000 Palestinian prisoners in Israel, many of them interned without charge or trial.
He believes that what the Americans are doing to the Iraqis amounts to a “carbon copy” of what the Israelis have been doing to the Palestinians.
“I am inclined to think that the Americans copied the Israeli techniques.   I can’t prove it in an objective manner, but the striking similarities are overwhelming.”
Abd al-Razzaq, who himself experienced many forms of torture during his lengthy imprisonment in an Israeli jail prior to the Oslo Accords in 1993, described physical and psychological torture as the “modus operandi” of Israeli treatment of Palestinian detainees.

He said that the so-called hooding technique — whereby the detainee's head is covered with a rancid-smelling sack for weeks or months — was always “the first order of business” in Israeli interrogation centres.
“The hooding itself is not an interrogation method.  Its purpose is not to extract confessions from the suspect, but rather to demoralise him and destroy his mental balance.”

Abd al-Razzaq said that the filthy sack that he too was forced to wear was made up of three or four layers to make sure that the suspect “breathes the least possible amount of oxygen, enough to keep him or her alive”.
In addition to the hooding, Israel, according to consistent reports by international human rights groups as well as testimonies by Palestinian detainees, continues to use harsh means of torture, both for extracting confessions and as a punishment for opposing the Israeli occupation.
These include, inter alia, brutal beating, (taltul) or violent shaking, forced-stripping, sleep deprivation (by playing extremely loud music inside a detainee’s cell), cold baths in winter, actual or threatened sexual abuse, as well as the notorious shabh technique whereby a suspect is tied tightly to a small chair, with his hands tied to his back, for weeks.
Similarity denied
Ofer Yisler, spokesman for the Israeli Prison Authority, vehemently denies any “similarity between our treatment of the Palestinians and what we have seen in Iraq”.
“There is no comparison whatsoever, what the Americans did in Iraq is something entirely different.”
But Yisler refused to comment on accusations that the hooding technique, the shabh, sleep deprivation and forced stripping were still being used by Israel.   Yisler ended the interview and refused to answer further questions, insisting that written questions be submitted to his office. <.font>

Yisler’s reluctance to speak, however, seems to underscore Israel’s desire to stay away from the international outcry over what happened in Iraq.
But Israeli-Arab Knesset member Talab al-Sanai says Israel is indirectly but heavily involved in “the systematic mistreatment of Iraqi people at the hands of the American occupation troops”.

“It is not secret at all, there are many Israeli experts on torture in Iraq who are transferring to the Americans their accumulative experience of thirty seven years of torturing and mistreating Palestinians,” al-Sanai told Aljazeera.net.
He said that American officers joined Israeli army units in Jenin several months ago for the purpose of learning Israeli methods and techniques of repressing civilians, which the Americans, he said, later applied in Iraq.
“It took Israel 37 years to develop and perfect these barbaric methods of repression and humiliation.   Surprisingly, the Americans surpassed and outmatched the Israelis in their savagery in less than two years.”
Al-Sanai condemned American behaviour in Iraq as “manifestly criminal”, dismissing claims by the Bush administration that the torture incidents were isolated.
“Here in Israel, it is an ugly occupation, and Israel doesn’t make any pretensions about it.   But in Iraq, the United States is murdering, humiliating, torturing and raping the Iraqis under the rubric of freedom and democracy:
“Perhaps this is what they really mean  when they talk about freedom and democracy: namely, liberating the Iraqis from their dignity.”

In Argentina "transferal" referred to the process of taking a person from the Naval Mechanics' School in Buenos Aires known locally as ESMA.
In an earlier incarnation it was an officers' casino.
In its later incarnation it was one of the detention centers to which political dissidents, leaders of the opposition and those considered a threat to the military dictatorship were taken from March 1976 until the end of 1983.
Its name notwithstanding, it would only have been considered a "school" by those who consider the use of torture as a teaching device to educate people as to what they should say to the torturer.
According to a description by Larry Rohter of the New York Times, the building had a long hall the name of which had something in common with "transferal" and "rendition." Its name was a euphemism. It was called "Happiness Avenue."
There were no stores on Happiness Avenue as there are on some of the elegant avenues in Buenos Aires. There were just rooms in which acts of torture took place.
"Happiness Avenue" was not a one-way street. Once the authorities completed the torture, which could go on for extended periods, the victim was drugged and participated in what the Argentine navy called "transferal."
The victim was taken to the airport, placed in an airplane, flown over and then thrown into the ocean.
Drowning was much pleasanter than the activities on Happiness Avenue. It had an end.
The United States uses "rendition" which loosely translated means "we provide the body, you perform the torture."
"We" is the United States government in the guise of the CIA and "you" is the country to which those the soon-to-be-tortured are sent.
Those who participate in rendition are sent to countries where torture is an accepted way of extracting information.
That is not, however, why they are sent there.
According to a report in the New York Times prisoners are moved to other countries in order to help the United States with budgetary problems.
Administration officials have said that sending prisoners to Egypt, for example, is an alternative to the "costly, manpower-intensive process of housing them in the United States or in American-run facilities in other countries."
The fact that those countries engage in torture is nothing more than a coincidence.
Even though rendition is primarily a money saving device, a number of individuals were tortured following their rendition.
Maher Ara is a Canadian citizen who was arrested at Kennedy airport, transferred to and tortured in Syria before being released without being charged with a crime.
Khaled el-Masri was arrested on the Serbia-Macedonia border, held and tortured for five months and then released without being charged.
His captors told him it was a case of mistaken identity.
They meant to torture someone else with his name.
He was an incidental beneficiary of the torture rather than its intended target.

EU concealed deal with US to allow 'rendition' flights
The European Union secretly allowed the United States to use transit facilities on European soil to transport "criminals" in 2003, according to a previously unpublished document.
The revelation contradicts repeated EU denials that it knew of "rendition" flights by the CIA.
...Asked in Parliament last week about reports of 400 suspect flights passing through British airports, Tony Blair said: "In respect of airports, I don't know what you are referring to."
The minutes of the Athens meeting on January 22, 2003, were written by the then Greek presidency of the EU after the talks with a US delegation headed by a justice department official. EU officials confirmed that a full account was circulated to all member governments, and would have been sent to the Home Office.
...According to the full version, "Both sides agreed on areas where co-operation could be improved [inter alia] the exchange of data between border management services, increased use of European transit facilities to support the return of criminal/ inadmissible aliens, co-ordination with regard to false documents training and improving the co-operation in removals."
...But this section, and others referring to US policy, were deleted — as a "courtesy" to Washington, according to a spokesman for the EU Council of Ministers.

Christians in America who applaud the murder of wounded prisoners
This is no surprise, because there are energetic Christians in America who applaud the murder of wounded prisoners.  They think it is wonderful to kill them.  They are proud that US soldiers kill helpless people.  Doubt me?  Read on.
Here is an email sent me following my piece in Counterpunch on March 7, from "Yours sincerely, Todd Hale, Senior Church Image Consultant (http://www.faithHighway.com/) and, who is one sick citizen, and wrote:
"You asked the question 'What was the reaction of most of the American people to the murder of a wounded, unarmed Iraqi lying helpless and barely conscious on the floor of a mosque in his own country?'
I think, based purely on the exit poll results of the recent Presidential election, re-affirming the current administration's stance on the war on terror, including Iraq, that most of the Americans, or at least 65 some odd million of them again based on the election results would be like mine; "Sucks to be him, he should not be fighting for an evil regime like Saddam Husseins, that aids and supports terrorists and has killed thousands of his own people with chemical weapons, and if said man does fight for Saddam, he risks death, even if he's wounded and lying on the floor of his mosque.  I only hope that someone shared the good news of the saving grace of Jesus Christ with him before he died.  You asked.  May God Bless your liberally challenged mind!"  [Emphasis in original.]
Let us all take a deep breath after these kindly words from a devout Christian and consider the rest of the Reuters' report:
"Army criminal investigators looked into the matter and decided no criminal charges were warranted against the soldiers.  Documents showed that the Army deemed the actions shown on the video "inappropriate" rather than criminal.  'It didn't rise to the level of criminal abuse, according to the investigations,' said LtCol Jeremy Martin, an Army spokesman at the Pentagon.  'Clearly, the soldiers probably exercised poor judgment . . . and I'm sure that they were admonished by their command for their actions'."
US military thug
Sure; the world can be certain that "their command" took disciplinary action.  Like issuing a bag of cookies and ten days' leave.  It is incredible to be told that a soldier who kicked a wounded prisoner was considered to have "exercised poor judgment".
The US military thug — for he cannot be dignified by the name of 'soldier'— kicked a helpless man in the face, but Lt. Col. Jeremy Martin, US Army, then spits in the faces of all of us when he says that the kicking "didn't rise [he meant, presumably, 'descend'] to the level of criminal abuse".
LtCol Jeremy Martin should go join Mr Todd Hale, the equally caring Senior Church Image Consultant, because they would have a lot to agree about.
Robot
LtCol Jeremy Martin of the Pentagon has no conscience.  He is a robot, poor fellow.  He is doing his duty as he sees it, of course, in the same fashion as the Army face-kickers and the Guantanamo Bay torturers and the Marine who murdered the unarmed, wounded prisoner lying semi-conscious on the floor of a mosque in Iraq last November, to the approval of millions of Americans.
He is a performing puppet, an unthinking, manipulated, rag-doll-in-uniform who does his best to please his masters, like countless other grey people for whom individual thought is a terrifying concept.
Big problem for America
And this is the big problem for America.  It is the little people, the Jeremy Martins of the uniformed brothers and the Todd Hales of the church brothers, who lead the populace in endorsing and actively supporting evil.
They are just folks like other folks, of course.
They live down the street or on the next block and they have 1.7 kids, an SUV and a couple of bicycles, a liking for the local baseball team, clean living and Church cookouts, and a deep and terrible ignorance of humanity, history, and tolerance.
Nazi Germany
Does anyone read William Shirer's ' Berlin Diary: Journal of a Foreign Correspondent ' nowadays?  He was a gifted American reporter who described life in Nazi Germany from 1934 through 1941 (and in 1959 wrote his masterpiece, 'The Rise and Fall of the Third Reich') , but the diary itself is a story of personal despair and recounts the series of Germany's national catastrophes that "slipped inexorably towards the abyss of war and self-destruction".
Bush has plunged America into the abyss of everlasting war, and the parallels between what Bush America is becoming and what Hitler's Germany became in the 1930s are as startling as they are repellent.
In Nuremberg in September 1934, Shirer wrote that "when Hitler finally appeared on the balcony for a moment [the faces in the audience] reminded me of the crazed expressions I saw once in the back country of Louisiana on the faces of some Holy Rollers . . . They looked up to him as if he were a Messiah . . ." and went on to record Hitler's shriek that "We are strong and we will get stronger!"

"There, in the floodlit night . . . the little men of Germany who have made Nazism possible achieved the highest state of being . . .: the shedding of their individual souls and minds — with the personal doubts and responsibilities and problems — until under the mystic lights . . . they were merged in the herd."
And in just such a speech on October 30, 2004 at the Target Center, Minneapolis, Minnesota (it's on the White House website), Bush said exactly the same thing: "We are strong, and we will get stronger."  And there was rapturous applause, just as at Hitler's Nuremberg. " . . . you know where I stand and where I intend to lead this country."  [Applause.] Audience:  "Four more years!  Four more years!  Four more years!",  just as Hitler was greeted with the adoring mass chant of  'Sieg Heil!,  Sieg Heil!,  Sieg Heil!'
The little people of America were speaking to Bush.  In the words of William Shirer describing Hitler's Germany, these were extremist Americans exactly like the Germans who "achieved the highest state of being . . .: the shedding of their individual souls and minds — with the personal doubts and responsibilities and problems — until under the mystic lights . . . they were merged in the herd."
Moral sewer that he made Germany become
It was the "little men", the ordinary people of the country, who first allowed and then encouraged Hitler to thrive in the moral sewer that he made Germany become in the Thirties.  On March 3, 1934, in a speech in Frankfurt, his vicious associate, Herman Goering declared: "Fellow Germans, my measures will not be crippled by any judicial thinking.  My measures will not be crippled by any bureaucracy.  I won't have to worry about justice, my mission is only to destroy and exterminate."
The modern Goering, John Bolton, nominated by Bush to be ambassador to the United Nations in a calculated insult to the entire world, believes "It is a big mistake for us to grant any validity to international law even when it may seem in our short-term interest to do so."
Beware, all those who seek justice, because, as Bolton wrote earlier, "Treaties are 'law' only for US domestic purposes" and have no meaning otherwise.
Hitler was given to double-think and double-speak, too
When international agreements become inconvenient for Bush Washington they can be unilaterally abrogated in a curt and contemptuous two paragraph note to the UN, as sent by Rice last week when Bush cancelled yet another long-standing accord.  What sort of example does Bush think this conveys to the world?
It is absurd for him to complain that other countries do not abide by international treaties or UN Security Council resolutions while he cancels US adherence to treaties and ignores flouting of UN resolutions by countries whose leaders have his approval.  But Hitler was given to double-think and double-speak, too, like all tinpot autocrats and would-be emperors.
The historian John Toland wrote in his masterly 'Adolf Hitler' (Doubleday, New York, 1976) that in mid-30s Germany "a revolution was going on, but since it was almost bloodless, many Germans did not, or chose not, to realize it.
This preliminary stage of the Revolution was given an innocuous name: 'Co-ordination'.
It appeared to be an efficient process of unifying the nation and was received with little alarm."
And just as the Patriot Act was thrust under the guard of the American people, so the German Nazis unified their country with promises of better things to come, emphasis on ultra-national pride, and utter contempt for foreigners and those within their national borders who did not conform to the standards of what the Leadership dictated.
For the Protection of the People and the State
The Nazi's equivalent of the Patriot Act was the decree "For the Protection of the People and the State" of February 28, 1933, which laid down that:
"Paragraphs 114, 115, 117, 118, 123, 124, and 153 in the German Reich Constitution are provisionally null and void.  Accordingly, the restrictions on personal freedom and the right to express opinions freely, including freedoms of the press, association, and assembly; monitoring of letters, cables, and telephone calls, searches of homes, and expropriation of property, and restrictions thereon, are hereby revoked within the limits previously stipulated in the law."
It is bizarre that not a single US legislator actually read the Patriot Act before voting for it (although one honorable and intelligent senator voted against it and was of course then reviled).  It was impossible to read it before voting, given the length of the document, the hundreds of cross-references, and the time available.
And millions of Americans who haven't read the Act or know anything about it agree with it completely because they have been brainwashed to embrace fanaticism.

The Patriot Act is uncannily similar to Hitler's decree that set Germany on the slide to moral destruction, and unlike the Patriot missile system, it actually works.  (During the invasion of Iraq, US Patriot missiles downed a US Navy F-18 and a British Tornado, and a Patriot radar was destroyed by a USAF F-16 before it could be vaporized, too.)
I wrote in May last year that "The Patriot Act alters 15 Statutes.  The prerogatives, personal authority and dominance of the president of the United States have been extended to include drastic and quasi-imperial powers that threaten the liberties of all Americans."
This followed a speech by Bush to the faithful in the Chocolate Ballroom in Hershey, Pennsylvania when he declared to cheers that "The Patriot Act defends our liberty . . . It's essential law . . . It's a law that is making America safer . . . It doesn't make any sense to scale it back".
But if an American dares criticize the president in vehement terms, and that fact is recorded by some busybody, then the FBI can place such information on a citizen's file.  (This has happened.)  The citizen will never know about this, except through revelation by true American patriots, because the FBI's subpoena cannot be challenged in court and the victim of the Patriot Act is kept in ignorance about its ever being served.
Can this be freedom?  No: this is Bush freedom.
Which includes the freedom for a US citizen in uniform to kick a manacled prisoner in the face and for the world to be told that his cowardly cruelty was only a matter of "poor judgment".
It is the freedom for a US citizen in uniform to kill helpless, wounded, unarmed captives, secure in the knowledge that millions of good Christian Americans, including 'Todd Hale, Senior Church Image Consultant', will approve the murder and defend it against all tenets of law and morality.

Charles Mackay, in his "Extraordinary Popular Delusions and the Madness of Crowds", published in 1841, was of the opinion that "In reading the history of nations we find that . . . millions of people become simultaneously impressed with one delusion, and run after it until their attention is caught by some folly more captivating than the first.
We see one nation suddenly seized, from the highest to its lowest members, with a fierce desire for military glory . . . Men, it has been well said, think in herds . . ."
Bush "freedom" is based on the belief of Cheney, Bolton, Rice, Rumsfeld, and other warped figures in the Nazi creed that "We are strong and we will get stronger".
The catchword has caught the attention — the worship — of the deluded crowds, the herds, the millions who have been brainwashed by patriotic persuasion that if they disagree with national policy they are traitors, no matter how immoral that policy might be.
Hitler's sycophants applauded his insane ambitions to dominate the world, and in Bush Washington the same type of people bow and scrape and applaud his voodoo schemes to impose "freedom" by the bomb and the bullet.
America has lost all international moral authority it ever had, courtesy of a messianic ninny who seeks to construct an ethically corrupt system that encourages the strong to persecute the weak, the rich to despise the poor, and credulous bigots to triumph over common sense and decency.
If someone doesn't agree with you, then go kick him in the face.
It doesn't demand thought, and millions of people will think you're a great patriot.

In 1983 I did radio tornography with 30 watts looking for oil in the ground.
I found 26 oil wells over a nine state area.
